Dealing With Housing Benefit Issues For Recent Arrivals From European Countries

 

A Workshop which seeks to look at the issues involved when assessing and advising on Housing Benefit claims from persons from abroad, including the key aspects of law and an explanation of the main rules affecting entitlement. An ideal Workshop for Housing Advice and Income Management Officers from the Housing Sector, as well as local authority benefit assessment staff and welfare rights advisors.

A Workshop designed and presented by Peter Barker (the ‘HB Anorak’) to provide people involved in this complex area of Housing Benefit and Council Tax Benefit with a good understanding of the key rules and legal aspects when dealing with a HB claims for recent arrivals from Europe. (Note: Claims from non-EAA Nationals are covered in a separate Workshop).Arguably the most knowledgeable and experienced trainer in this topic, Peter will clarify the different issues that are involved when dealing with claims from this client group, many quite complex, and explain who is entitled to make a claim and who is not.

 

The day will get to grips with some of the tricky problems and tough issues that arise when dealing with this claimant group, and include material from European and domestic legislation as well as case law from the European Court and the domestic Courts. New Court decisions are being handed down all the time and the Workshop will look at the most important of the recent cases from 2011, as well as the enduring landmark cases that remain relevant today. The course will particularly look at the law behind the “right to reside” test – understanding European Treaties, Directives, Regulations and case law.  There will also be a comprehensive analysis of all the categories of economic activity in which a European has a right to reside in the UK..

 

Important issues that will be covered during the day will include: 

  • Fact or fiction about European benefit claimants!
  • Understanding European residence law;
  • The habitual residence / right to reside test;
  • Europeans in the jobs market;
  • Europeans outside the jobs market;
  • Identifying family members who have a right to reside alongside the principal EEA national;
  • Self-employment issues;
  • Student issues;
  • Issues for those incapable of work;
  • Effective and genuine work;
  • Retention of status while unemployed or sick;
  • Self-sufficiency;

The Workshop is aimed at staff with a reasonably good prior knowledge of Housing Benefit issues who want to look more in-depth at this complex topic. By means of presentations, discussions and exercises our presenter, Peter Barker, will provide a fact-filled and rewarding day covering the most up-to-date information available.

Peter Barker

 

Peter Barker has worked in the field of benefits since 1985. His previous posts include working for the Citizens Advice, Westminster City Council and the Local Government Ombudsman, where he edited the in-house Housing Benefit practice note.He now works as a trainer, appeals presenter/submission writer and specialist adviser.

Peter regularly presents at both First-tier and Upper Tribunals and he is well-known to Housing Benefit practitioners for his regular contributions to the HBINFO discussion forum and conferences. Peter has presented and developed hundreds of courses over the last few years and his analytical skills and enthusiasm for his subject are unmatched.

Peter is an expert on the decisions and appeals adjudication framework and European rights of residence. He has a detailed knowledge of case law and he has recently developed a methodology for resolving disputes about supported and exempt accommodation.
