A Workshop designed and presented by John Zebedee to provide people involved in this complex area of Housing Benefit and Council Tax Benefit with a good understanding of the key rules and legal aspects when dealing with a claims from recent arrivals / persons from abroad. The course will clarify the different issues that are involved when dealing with claims from this client group, many quite complex, and explain who is entitled to make a claim and who is not.

The Workshop will look at the thinking that is behind the three main ‘Tests’ – Subject to Immigration Control, Right to Reside, and Habitual Residence – and will also look at the similarities and differences that exist between them. Related case law will also be considered. Reference will also be made to the different situations for single people, couples and families.

Which rules apply where in respect of claims from people from European and non-European countries will be explained. For claims from EEA Nationals the course will look at specific issues surrounding the various client groups, including Jobseekers, Students, Self-employed Workers, Retirees and Family, plus the more stringent tests for Accession State Nationals.

The course will also look at the specific issues involved when dealing with claims from non-EEA nationals, and some of the key immigration control issues. Terminology will be explained, and the often problematical issue of limited funds will also be discussed. The specific rules and issues to consider for Asylum Seekers and Refugees, including humanitarian protection, discretionary leave and other matters will also be covered.

Important: This Workshop is designed specifically as a basic course for Front Line Staff to look at Housing Benefit entitlement issues when dealing with claims from recent arrivals / persons from abroad. It does NOT cover matters relating to Immigration Law itself, nor the practical and legal issues relating to immigration matters other than those that are directly related to assessing a person’s entitlement to Housing Benefit.

The Workshop is aimed at staff involved in front line benefits advice and assessment of HB claims, and not senior managers or senior policy officers. It is an introductory/medium level Workshop targeted specifically at front line staff who deal directly with HB claimants, and does NOT cover issues of ‘evidence’, such as ID, Home Office papers, Worker Certificates, etc. By means of presentations, discussions and exercises our presenter, John Zebedee, will provide a fact-filled day covering the most up-to-date information available.
